TERMS & CONDITIONS
INTRODUCTION
Welcome to Full Body Pilates & Movement Therapy’s website. By accessing and using this website, you agree to the terms and conditions outlined below. These terms govern your use of the site and participation in our online and studio services.
DEFINITIONS
• “Full Body Pilates” means Pilates Couple, Inc., doing business as Full Body Pilates & Movement Therapy and located at 14751 Plaza Dr, #1A , Tustin, CA 92780.
• “Website” means www.fullbodypilates.com.
• “Client” means any person who uses the website or participates in Services.
• “Services” means all Full Body Pilates registrations, classes, sessions, memberships, and other offerings.
WEBSITE USE
Users agree to use the website in a lawful manner and follow all guidelines. Any misuse, including spamming, hacking, or attempting to disrupt the service, is prohibited.
ACCOUNT REGISTRATION
Clients creating accounts on the Full Body Pilates website must provide accurate and up-to-date information. It is the user’s responsibility to keep their login credentials secure.
SERVICES PROVIDED
The Full Body Pilates provides a range of services, including private sessions, small group Pilates sessions, and apparatus group classes. A selection of retail items is also available for purchase at the studio.
NEW CLIENTS
We welcome new members. We strongly advise new members to take advantage of our new Client special and take 3 private classes prior to group classes, to familiarize and properly use Pilates equipment safely. If a member decides to go to group classes first we advise to enroll in a stretch mix levels 1/2 for beginners.
Demos are seasonal, check back on the schedule regularly.
CLOTHING AND ATTIRE
Grip Socks are required and must always be worn during class due to safety and hygienic requirements.
ROLLOVER POLICY:
Any unused classes from one monthly cycle may roll over to the next monthly cycle, however, must be used by the end of that monthly cycle. They expire if unused after one month.
Limited Contracts (4, 8, 12, 16, 20 classes per month) are the maximum number of classes available for a specific month. When the month ends, any unused classes will roll over for one month and then they will expire on the following month. Please plan accordingly.
CONTRACT SUSPENSIONS
- Updated contact pausing feature:
- 6 month contracts- 2 weeks minimum and 3 months maximum;
- 3 month contracts- 2 weeks minimum and 2 months maximum;
- A service fee of $25.00 will be charged per month per contract paused,
- Pausing contracts is only allowed 1 time per 3 or 6 month contracts;
- Clients will NOT be allowed to use classes while contract is paused:
- The amount of days paused will be added to the contract. The date of the payment may change as well as the expiration date of the contract. We won’t know the date of payment until contract is re-activated.
Please email the dates of your requested suspension to manager@fullbodypilates.com at least 30 days prior to the requested suspension (planned absences, vacations, etc.).
In the case of an emergency (injury, surgery, etc.) contracts may be suspended with less than 30 days notice.
CONTRACT CHANGES
The six month contracts can be upgraded or downgraded after completion of three months of the six months contract, and a $50 service fee will be applied to change the contracts.
CONTRACT CANCELLATIONS
Cancellation of three and six month contracts is not permitted until the contracts are fulfilled.
Contracts automatically renew every three to six months. You will be contacted seven days prior to the contract expiration date as a reminder. If the contract period has been fulfilled and you do not want to renew, please email us five days prior to the expiration date of the contract.
FOR NEW CONTRACTS ONLY:
We give you the option of canceling the contract within 5 days of purchase if you decide to change or cancel the contract.
LATE CLASS CANCELATION POLICY
For group classes we request that you provide at least a 12-hour notice on week days and 24-hour notice for weekends and holidays prior to your scheduled class time to avoid incurring a late cancellation fee. Cancellations should be made online or on the app through MIND BODY. Should a class need to be rescheduled for a different class time on the same day, please make those changes online or on the app by selecting the late/early cancel option to the scheduled class, and then adding the desired class.
For private, duet, and trio appointments we request that you provide at least a 24-hour notice prior to your scheduled session. Please contact the studio number at (714) 455-1430.
Cancellations made with less than a 24 hours notice may be charged the full price of the session.
Please ONLY cancel your group classes online.
UNLIMITED CONTRACTS ONLY
Clients with unlimited 3 or 6 month contracts will be charged a service fee, late cancel fee $10./ no show fee of $20.
Please cancel online as soon as possible if you cannot attend, as a courtesy to other interested clients. The App opens the reserved reformer and class for another client that may be on the waiting list.
In the event of an emergency cancellation, the client should text or call the studio directly after canceling online.
LIMITED CONTRACTS ONLY
All clients with Limited contracts, group packages and/or drop-in classes, will lose that class if they late cancel and no-show will lose a class and incur a service charge/no show fee of $10. The cancellation period is 12 hours prior to the scheduled class for week days and 24 hours prior to the scheduled class for weekends and holidays.
Please cancel online as soon as possible if you cannot attend, as a courtesy to other interested clients. The App opens the reserved reformer and class for another client that may be on the waiting list.
In the event of an emergency cancellation, the client should text or call the studio directly after cancelling online.
WAITING LIST FEATURE
Joining the waitlist is a great way to secure a spot in full classes.
To get the most out of this feature, be sure you know how to track and manage your waitlist status in the MindBody App.
Automatic Add-In
- You may be automatically added into a class up to 2 hours before class time.
- If you do not wish to be charged, please remove your name from the waiting list ahead of time.
Paid Class Required
- You must have a paid class available on your account to join the waiting list.
- If you don’t, your name will not be added, and you may not get into the class.
For Limited Contracts
- If you cancel a class you’ve already booked (after receiving a notification), the next person in line will automatically take your spot.
- This means you may lose the chance to back in, depending on your position on the list and classes pass available.
- If no one else is waiting, and a spot becomes available, you may still be added as long as you have a paid class available at that time.
For Unlimited Contracts
- This usually does not affect you, unless you are booking more than 2 months ahead of your payment date since you are allowed to book one class per day.
Late Cancels & No Shows for all contracts, packages, new client specials and drop in classes
- If you accept a spot and cancel within the late cancellation window, you will be charged a late cancel or no-show fee.
- If a spot opens within 2 hours of class, we will contact you manually. If you decline by texting the studio number, you will not be charged.
If You Can’t Make It (Last Minute)
- To avoid no-show or late cancel charges, please remove your name from the waiting list:
12 hours before class on weekdays
24 hours before class on weekends & holidays
Extra Classes for Wait-listed Clients
- Sometimes, we add an extra class to accommodate wait-listed clients. If your name is on the list, we assume you are still available to attend.
SALES AND REFUNDS
- All purchases are non-refundable. Exchanges may be made for upgrades or alternate packages.
- If a package or special promotion was purchased, please note the expiration date as the expiration date on these purchases cannot be extended.
- Pilates prices are subject to change without notice.
- All clients with contracts (limited and unlimited) are required to have a valid credit card on file.
- Instructors and schedules are subject to change at any time without notice.
- Each year Full Body Pilates and Movement Therapy will close from Christmas through New Year’s Day.
- Full Body Pilates and Movement Therapy reserves the right to refuse service to anyone.
LIABILITY WAIVER
By participating in Full Body Pilates classes or sessions, you acknowledge and accept the inherent risks associated with physical exertion and exercise. You agree to release and hold harmless Full Body Pilates, its owners, instructors, and employees from any liability for injuries, accidents, or illnesses sustained during participation.
Prior to attending any class or session, all clients are required to review and sign our full Liability Waiver, which details the terms of participation and the assumption of risk. Participation in any services is contingent upon the completion of this signed waiver.
ASSUMPTION OF RISK
You assume full responsibility for your participation in classes and agree to inform your instructor of any injuries or limitations. You are responsible for following the instructor’s advice and stopping any exercise that causes discomfort.
HEALTH AND MEDICAL CONDITIONS
Clients must disclose any medical conditions or injuries before participating in classes, including but not limited to Osteoporosis, Osteopenia, or any other medical limitations.
PRIVACY AND DATA PROTECTION
We collect personal data through Mindbody to manage bookings and payments. Please refer to Mindbody’s privacy policy for more information on how your data is managed. We do not store full credit card information, only partial details for reference.
INTELLECTUAL PROPERTY
All content, including images, text, and logos on the website, is the property of Full Body Pilates and may not be used without permission.
COMMUNICATIONS
By using our services, you consent to receive electronic communications, including account-related information, marketing materials, and transactional updates.
PROHIBITED USE
Clients are prohibited from creating fake accounts, engaging in fraudulent activity, or misusing the online booking system.
THIRD-PARTY LINKS
Our website may include links to third-party services, such as Mindbody. We are not responsible for the functionality or content of these external sites.
CHANGES TO TERMS AND CONDITIONS
We reserve the right to modify these terms at any time. Changes will be posted on this page with the latest revision date. Your continued use of the website and services after any changes constitutes acceptance of the new terms.
GOVERNING LAW
These terms are governed by the laws of the State of California. Any disputes arising from these terms or your use of the website shall be subject to California law and jurisdiction without resort to conflict of law principles. Venue shall be in the Superior Court of Orange County, California.
We reserve the right to refuse service to anyone.
